LOTSI Club — terms of participation

LOTSI CLUB LOYALTY PROGRAMME — TERMS OF PARTICIPATION
applicable to our online store and to LOTSI retail stores

1. Introductory provisions

1.1 These terms govern participation in the LOTSI Club loyalty programme (the “programme” or the “club”), the rights and obligations of its members, and the way loyalty discounts are granted.

1.2 The programme is operated by Vladimír Obuch, Podhorská 3, 902 01 Pezinok, Slovakia, registered in the Trade Register of the Slovak Republic, reg. no. 1634/99, company ID (IČO): 36981729, tax ID (DIČ): 1020150659, VAT ID: SK1020150659, tel. +421 918 112 650, e-mail: info@lotsi.sk (the “operator”).

1.3 The programme also applies in the LOTSI retail stores (the “stores”). Some of the stores are operated by the operator, others by LOTSI s.r.o., Podhorská 3, 902 01 Pezinok, Slovakia, company ID (IČO): 53642449. The operator and LOTSI s.r.o. jointly determine the purposes and means of processing members' personal data and are joint controllers in this respect under Article 26 of Regulation (EU) 2016/679 (GDPR).

1.4 The essence of the joint controllers’ arrangement is as follows: the operator maintains the membership account, runs the online store and the loyalty system, calculates the membership tier and handles all member requests; purchases made in a store are recorded and passed to the loyalty system by whichever party operates that store. The operator is responsible for providing the information required by Articles 13 and 14 GDPR. Members may exercise their rights under the GDPR against either of the two controllers. The operator is the point of contact for members in all matters concerning the programme and data protection, e-mail: info@lotsi.sk.

1.5 Participation is free of charge and voluntary. Membership is open only to natural persons aged 16 or over who act as consumers, that is, outside the scope of their trade, business, craft or profession.

1.6 These terms are available on the programme page and in the footer of the online store. Matters not covered by these terms are governed, as appropriate, by the operator's terms and conditions.

2. Becoming a member

2.1 You can join the club in a store or in the online store. By joining, the member confirms that they have read these terms and agree to them; the terms are made available to them at that moment in the version then in force. The operator keeps a record of that confirmation for the duration of the membership.

2.2 In a store, membership begins at the moment of registration on the spot.

2.3 In the online store, the member joins by ticking the relevant box in their customer account or in the basket. Membership takes effect when their next order is completed and the enrolment is passed to the loyalty system. Until that moment there is no entitlement to the loyalty discount, and the membership cannot be used in a store either.

2.4 Membership is tied to a specific person and their e-mail address. It is non-transferable and cannot be assigned to another person or merged with another person's membership.

2.5 A person may hold only one membership. If the operator finds that the same person holds more than one membership, it may merge them or close the duplicate membership.

3. Membership tiers

3.1 The programme has four tiers. Your tier is determined by the total value of your purchases over the last 12 months:

  • Bronze — 5 % discount, on joining the club
  • Silver — 10 % discount, from €700
  • Gold — 15 % discount, from €1,300
  • Platinum — 20 % discount, from €3,000

3.2 The total is calculated from the price of goods actually paid by the member after all discounts. Delivery charges and the value of gift vouchers at the time of their purchase are not included.

3.3 Purchases made in the online store and in the stores both count towards the total. A purchase in a store counts if, before paying, the member presents the QR code from their customer account or gives the e-mail address linked to the membership. The purchase during which the member joined the club also counts towards the total.

3.4 The reference period is the last 12 months, counted back from the current day. The tier is recalculated on an ongoing basis. If the total for the last 12 months falls below the threshold of a given tier, the tier is reduced accordingly. Bronze is the lowest tier and applies throughout the membership.

4. How the discount is applied

4.1 The discount is applied automatically. In the online store it appears in the basket and at checkout provided the member is signed in to their account. In a store it is applied on presentation of the QR code or the e-mail address. No discount code is needed.

4.2 In a store, the discount is also applied to the purchase during which the member joined the club.

4.3 In the online store, the discount applies from the first order placed after joining. It does not apply to the order during which the member joined the club, because membership begins only when that order is completed.

4.4 A change of tier applies to orders placed after the new tier has been reached. It has no effect on orders already submitted.

5. Limitations and exclusions

5.1 The loyalty discount applies to goods sold at the regular price. It does not apply to goods that are already reduced, being cleared, or included in a promotion.

5.2 The loyalty discount cannot be combined with other discounts, discount codes or promotional offers. Where more than one discount could apply to the same item, the one more favourable to the member is applied.

5.3 The loyalty discount does not apply to gift vouchers or to delivery charges.

5.4 The loyalty discount has no monetary value. It cannot be paid out in cash, transferred to another person, or applied retrospectively to orders already completed.

6. Returns

6.1 If a member returns goods or withdraws from the contract, the price of the returned goods is deducted from the total value of their purchases. If the total then falls below the threshold of the tier reached, the tier is reduced.

6.2 Where goods were bought with a loyalty discount, the amount refunded is the amount the member actually paid, that is, the price after the discount.

6.3 The member's right to withdraw from the contract and their rights arising from our liability for defects are not affected in any way by participation in the programme.

7. Ending the membership

7.1 A member may end their membership at any time by writing to info@lotsi.sk. There is no charge, and it has no effect on orders already completed.

7.2 Membership also ends when the customer account is deleted.

7.3 When membership ends, the member loses the tier reached and the entitlement to the loyalty discount. If they join the programme again, the total of purchases starts from zero as at the new enrolment.

7.4 The operator may end the membership of a person who misuses the programme, in particular by giving false information, by creating more than one membership for the same person, or by acting in a way aimed at obtaining a discount without entitlement. The operator will notify the member in advance and state the reason.

8. Changes to the programme and its discontinuation

8.1 The operator reserves the right to amend these terms or to discontinue the programme on any of the following agreed grounds: a change in legislation or a decision of a public authority; a change in the technical or organisational way the programme is delivered, including a change of the loyalty system provider; a change in the scope of the benefits offered; or discontinuation of the programme as a whole. Any amendment to the terms and any discontinuation of the programme will be announced on the programme page and by e-mail to all members at least 30 days in advance.

8.2 The existing terms remain in force until that period expires, and during that period the member may continue to claim the discount corresponding to the tier reached.

8.3 A member who does not agree with an amendment may end their membership under clause 7.1 before that period expires.

8.4 Neither an amendment to these terms nor the discontinuation of the programme affects orders submitted before the amendment took effect or before the programme was discontinued.

9. Personal data

9.1 For the purposes of the programme we process the member's identification and contact details, data on their purchases in the online store and in the stores, the tier reached and the history of its changes.

9.2 The legal basis for the processing is performance of the contract constituted by these terms, under Article 6(1)(b) GDPR.

9.3 The data are processed for the duration of the membership. Details of the processing, of the recipients of the data and of your rights as a data subject are set out in our Privacy Policy.

10. Final provisions

10.1 Participation in the programme does not create any entitlement to conclude a purchase contract or to the availability of any particular goods.

10.2 These terms and the legal relationships arising from them are governed by the law of the Slovak Republic. This does not affect the protection afforded to consumers by the mandatory provisions of the law of the country of their habitual residence.

10.3 Supervision of the operator's compliance is carried out by the Slovak Trade Inspection Authority, Inspectorate for the Bratislava Region, Bajkalská 21/A, P. O. BOX no. 5, 820 07 Bratislava, Slovakia, www.soi.sk. Consumers may also turn to an alternative dispute resolution body: Slovenská obchodná inšpekcia, ústredný inšpektorát, Department of International Relations and Alternative Dispute Resolution, Bajkalská 21/A, p. p. 29, 827 99 Bratislava 27, Slovakia, e-mail: ars@soi.sk. The European Commission's online dispute resolution platform was shut down in July 2025 and is no longer available.

10.4 These terms take effect on 4 September 2026.
